What is a Strata Scheme?

 

A strata scheme is a type of ownership where a number of people own a property together. The property is usually a building, but can also be land or a combination of both.

​

The most common form of strata title is the Strata Scheme, which is created when a property is divided into individual units and common property. The most common type of unit is one which is designed for occupation by a single family. Despite the name, strata title can be used for any type of property. The Strata Schemes Management Act 1996 (SSMA) sets out the rules that govern strata schemes in New South Wales. The laws were introduced to protect owners, tenants and visitors in strata schemes. By law, the Owners Corporation must allow an owner or tenant access to their unit, Common Property and any facilities provided for the use of Owners Corporation Members.

Identifying Common Property in a Strata Scheme

 

With the rise in popularity of strata title living in Australia, an increasing number of buildings are being constructed or converted for strata subdivision. As a result, the need for reliable legal advice on strata law is more important than ever.

One of the most common questions we are asked is "what is common property in a strata scheme?" and it's not always an easy question to answer.

​

One of the first things we need to do when advising a client is to identify what is and isn't common property in the particular scheme. This can be complicated by the fact that each strata scheme is different and as such the answer will change from one to another.

​

For example, common property in a strata scheme will often include the external walls of a building, stairs, foyers and roofs. However, it is important to note that this will only be the case with an external wall if it is one of the walls shared between two self-contained dwellings.

If the external wall in question does not separate self-contained dwellings, then it is generally not common property as defined in the Strata Schemes Management Act 1996 (SSMA)
